TOV Zoning Board of Appeals (ZBA) Organizational Meeting

January 11, 2023

Call to order: 2022 Chairman John Pavelock called the meeting to order at 6:27 pm and led attendees in The Pledge of Allegiance to the Flag.

Attendance:

ZBA Members: John Pavelock, Amanda Hewitt, and Joshua O’Kay.

Randy Chandler was unable to attend. There is one vacancy on the board.

Others: Liaison Gail Whitham. Zoning/Codes Officer Reay Walker was unable to attend.

Minutes Approval:

Amanda Hewitt made a motion to approve the minutes for the December 5, 2022, ZBA Special Meeting. Seconded by Josh O’Kay. Poll Vote: Josh O’Kay – Aye, Amanda Hewitt – Aye, John Pavelock – Aye, Randy Chandler – Absent, Vacancy – n/a. Motion Carried.

Correspondence:

Secretary Pavelock summarized the correspondence since the last ZBA meeting including:

  • Phone calls with Matt Stubley (Park Outdoor Adv) regarding VAR2022-03. The application was withdrawn prior to the scheduled December 14, 2022 meeting. The secretary communicated this to the ZBA.

  • Coordinated the Legal Notice for this meeting with the Town Clerk.

  • Received the 2023 Local Government Conference (LGC) flyer.

    Public Hearings: None Unfinished Business: None New Business:

    Town Council appointments

    • 2023 ZBA Chairman is John Pavelock.

    • 2023 ZBA Secretary is Kathy Pavelock.

    • Josh O’Kay was re-appointed to the ZBA with a term of 2023-2027. Josh was advised that he needs to be sworn in before the end of January.

ZBA Vacancies

Secretary Kathy explained that Randy Chandler has agreed with Supervisor Davis that he would stay on the board for one more year. Supervisor Davis thought it was one more term. Randy considers his service complete. There are now 2 vacancies on the ZBA.

Liaison Whitham stated the Town Council will be advertising again to see about interest in filling the vacancies. The ZBA asked that Liaison Whitham relay our concern about a 5-member board having 2 vacancies. The three active members will be always needed to make a quorum and if one is unable to attend, the meeting will need to be cancelled.

Town residents will be affected if there are delays with the ZBA meeting.

Plans to discuss the sign law with the Planning Board

Chairman Pavelock will plan to attend a Planning Board Meeting to relay the ZBA’s concerns about the current sign laws.

Local Government Conference

Secretary Pavelock will coordinate the registrations for ZBA members interested in attending this conference on April 6, 2023 at Turning Stone. Gail, John, Amanda, and Josh are interested in attending.


John Pavelock made a motion to adjourn, seconded by Amanda Hewitt. All in favor. Motion Carried at 6:47 PM.
