TOV Zoning Board of Appeals (ZBA) Organizational Meeting

January 12, 2022

Call to order: 2021 Chairman Rick Mansfield called the meeting to order at 7:04 pm and led The Pledge of Allegiance to the Flag.

Attendance:

ZBA Members: John Pavelock, Rick Mansfield, Amanda Hewitt, and Randy Chandler.

There is one vacancy on the board.

Others: Liaison Gail Whitham, Secretary Kathy Pavelock, Supervisor Mike Davis, Councilwoman Wendy Herbst, QCN Reporter Sue Halbritter, and Resident Josh O'Kay. Zoning/Codes Officer Reay Walker was unable to attend.

Minutes Approval:

Rick Mansfield made a motion to approve the ZBA November 10, 2021 Special Meeting minutes with one correction to clarify the reason for the motion to dismiss Var2021-3. Seconded by John Pavelock. Poll Vote: Amanda Hewitt - Aye, John Pavelock - Aye, Randy Chandler - Aye, Rick Mansfield - Aye, Vacancy - n/a. Motion Carried.

Correspondence:

Secretary Pavelock summarized the correspondence since the last ZBA meeting in November including coordination for this meeting, preparation of the 2021 ZBA training certificat ion, and updating of the ZBA contact list.

Public Hearings: none Unfinished Business:

  • John Pavelock expressed his appreciation to the ZBA for their efforts and conduct at the November 10, 2021 ZBA meeting.

  • Rick Mansfield asked to make few remarks. He also expressed his appreciation to this board. He stated that he will stay on as a member of the ZBA but is not interested in serving as chairman. He also informed the board that each ZBA member will receive $100 per year beginning in 2022 for serving on the board.

  • The ZBA formally thanks Rick for his service as Chairman.

    New Business:

  • Supervisor Davis - Supervisor Davis requested to a chance to speak with the ZBA on a number of topics:

    • As required by town law, the Town Council has appointed John Pavelock as the 2022 ZBA Chairman. According to Town Law Section 267, the town council is responsible for appointing new members and the chairman. The ZBA is responsible for appointing a secretary and co-chair if appropriate.

    • Randy Chandler has been reappointed by the Town Council to serve another 5-year term.

    • Mr. Joshua O'Kay has applied to fill the ZBA vacancy. He is present this evening to meet the ZBA. Supervisor Davis asked the ZBA to have a recommendation send to the town council regarding Mr. O'Kay.

    • The town council has appointed Kathy Pavelock as the ZBA Secretary for 2022. He asked the ZBA to send any concerns regarding this appointment to the town council.

    • Supervisor Davis explained that the TOV Ethics Law is to be distributed to every employee (paid and unpaid) and that employees are to acknowledge receipt of the law. This has not been done in the past. To rectify this, Supervisor Davis distributed a copy of the law and an acknowledgement form for each ZBA member. Signed acknowledgement forms should be submitted to the Supervisor. Secretary Pavelock agreed to collect signed forms and to ensure that the person who fills the current vacancy is provided copies.

    • Councilwoman Gail Whitham has agreed to be the liaison for the ZBA. Supervisor Davis also introduced Councilwoman Wendy Herbst who will be Gail's backup.

    • Before leaving the meeting , Supervisor Davis expressed his pleasure in working with the ZBA over the last year.


  • Applicant to fill ZBA vacancy - The ZBA talked with Joshua O' Kay to find out more about his background. John Pavelock made a motion to recommend to the Town Council to appoint Joshua O'Kay to fill the vacancy on the ZBA. Seconded by Amanda Hewitt. Poll Vote:

    Amanda Hewitt - Aye, John Pavelock - Aye, Randy Chandler - Aye, Rick Mansfield - Aye, Vacancy - n/a. Motion Carried.


  • ZBA Secretary-The ZBA talked with Joshua O' Kay to find out more about his background. Rick Mansfield made a motion to agree with the Town Council appointment of Kathy Pavelock as the 2022 ZBA Secretary. Seconded by Randy Chandler. Poll Vote: Amanda Hewitt - Aye, John Pavelock - Aye, Randy Chandler - Aye, Rick Mansfield - Aye, Vacancy - n/a. Motion Carried.


  • Training - Secretary Pavelock announce a 2022 training opportunity. The Local Government Conference will be held April 19 at the Turning Stone and provides 6 hours of training. The town will cover the registration feed. Anyone who would like to attend, is to notify Kathy as soon as possible so that the town can get you registered. Rick, Amanda, and John would like to attend. Randy will be out of town.

The Harassment and Discrimination training is required annually for all employees (paid or unpaid). This training does not count towards planning/zoning training. One class is scheduled for January 19 with additional dates to be announce throughout the year. Kathy will forward any of these opportunities as they are announced. Please forward certificates to Kathy and she will provide them to the Supervisor.

Rick Mansfield made a motion to adjourn. Seconded by Randy Chandler. All in favor. Motion Carried at
