CALL TO ORDER:

Supervisor Davis called the meeting to order at 7:00 pm.

Shaun House, Chief of the Cleveland Fire Department, Presented Supervisor Davis with a Life Saving award for bringing back a victim in full arrest.

 

NOCCOG:

Lisa Bellinger reported that the NOCCOG annual fall dinner meeting is October 24th, Community Agritourism Webinar is October 9th, SUNY Potsdam Local Government Conference is October 15th, Tug Hill Commission is to meet October 21st, and $50 million was launched for the restore New York Communities Initiative Grant Program.

 

NORMAN LEACH:

Mr. Leach announced that Friday will be a County Executive Budget meeting, the Government has changed EMS Provider Rules to include giving blood transfusions and to be able to charge Medicaid for services provided, Sales Tax received went up, A 2.4 million dollar grant for Broadband is open to apply for, and because of the La Cross tournaments in Utica, local Hotels sales are up. The Family Court and DMV are projected to be open early next year. FEMA did not award money to Rome for the Tornado because they did not qualify because, of insurance reimbursements

A motion was made by Councilman Smith and seconded by Councilman Lamb to approve the September 4, 2024 Minutes.

AUDITED VOUCHERS:

A motion was made by Councilman Spellicy and seconded by Councilman Lamb to approve Abstract 10 Vouchers to be paid for a total of $ 587,693.52

TOWN CLERK'S REPORT:

Town Clerk read her report. Monies received for the month totaled $ 2208.86

Clerk Huber announce that she is now an official Notary Public. She also asked that the Board consider changing the hours on Thursday from 10:30 to 6 to 8:30 to 4:00 due to the fact that she has only had approximately 4 customers after 4:00 pm all year and she can schedule later appointments if necessary.

 

A motion was made by Councilwoman McEwen to approve the Town Clerk's Report and seconded by Councilman Smith.

ASSESSOR’S REPORT:

Assessor’s Report is filed in the Clerk’s office and will be posted on the Web Site.

 

CODE’S REPORT:

Codes Report is filed in the Clerk’s office and will be posted on the Web Site.

David Carpenter, Building Inspector was approved to attend the 2024 Annual Land Use Training Workshop. No cost for workshop but will be reimbursed for mileage and time.

Councilman Smith made a motion to reimburse costs of training and seconded by Councilman Spellicy.

HIGHWAY DEPARTMENT:

Supervisor Conover reported that Recreation Repair was taking care of the Stop Signs for Snowmobile Trail. Bells Road concerns about being a one-way road would have to be between the Town Lawyer and State. Supervisor Conover does not feel the need to have it one way. The crew has been working on fixing driveways and mailboxes. He did two interviews for the HEO and chose Shawn Sawyer and would like to have the Board approve his choice.

 

Councilman Smith made a motion to hire Shawn Sawyer as HEO and Councilman Spellicy seconded the motion.

COUNCIL REPORTS:

Councilman Smith will attend the ZBA meeting tomorrow evening. He commended the ZBA on the questioning Verizon at previous meetings and Verizon did not come prepared to answer questions.

 

Supervisor Davis explained that Ron Cole had the Petition signed and certified by the Assessor at 64.4% so the process will continue. The engineer filed the SEQR and Board has to declare to be the Lead Agency then a Public Hearing will come next, then a Permissive Referendum. We need to wrap this up by the end of the year to be able to apply for Grants that come out in February and March. The area is below the average income medium which looks good for receiving Grant Money.

 

Councilman Spellicy reminded everyone that Verizon is going through the proper channels for the Tower, as they went through the Planning Board, and are on the 3rd meeting with the ZBA.

 

OPENING OF SEALED BIDS FOR THE PURCHASE AND INSTALLATION OF NEW GENERATORS FOR THE VIENNA TOWN HALL & HIGHWAY GARAGE.

Supervisor Davis opened the two sealed bids received by the Town Clerk as follows:

 

911 Generators from Weedsport, NY bid $18,110.48 for the purchase & installation of Generator for Town Hall.

911 Generators from Weedsport, NY bid $31,144.96 for the purchase & installation of Generator for Highway Garage.

 

A motion was made by Supervisor Davis and seconded by Councilman Smith to accept the $18,110.48 for the purchase and installation of the Generator for the Town Hall.

OLD BUSINESS:

Cell Tower: Verizon is scheduled for a ZBA hearing October 3, 2024

 

Water Extension: Supervisor Davis read the following Resolution and voted

 

RESOLUTION NO.28 OF 2024

A RESOLUTION RELATING TO THE INITIAL REVIEW, UNDER THE STATE

ENVIRONMENTAL QUALITY REVIEW LAW, OF THE PROPOSED NEW WATER

DISTRICT PROJECT

WHEREAS, the Town of Vienna (Town) with offices at 2083 NYS Route 49, North Bay, Oneida County, New York is interested in undertaking a New Water District Project; and

WHEREAS, the Town Board must evaluate this project in light of the State Environmental Quality Review Act (SEQR), and the regulations promulgated pursuant thereto; and

WHEREAS, the Town Board has determined this project is a Type I action as that term is defined in 6 N.Y.C.R.R. Section 617.7(b)(6); and

WHEREAS, the Town Board has determined that other Federal, State, and Local agencies may be considered involved agencies; and

WHEREAS, the Town Board desires to serve and act as lead agency for purposes of SEQR; and

WHEREAS, to aid the Town Board in its determination as to whether the proposed project will have significant impact on the environment, part 1 of the Full Environmental Assessment Form (EAF) has been prepared, a copy of which is attached and a part of this Resolution.

THEREFORE, BE IT RESOLVED, the Town Board of the Town of Vienna, duly convened in the regular session, does hereby resolve as follows:

Section 1. Pursuant to, and in accordance with, the provisions of section 617.6 (Initial Review of Actions and Establishing Lead Agency) of the New York State Environmental Quality Review Regulations (6 NYCRR part 617) the Town Board of the Town of Vienna hereby makes the following determinations and classifications with respect to the Town’s Proposed New Water District Project.

a.     The application constitutes a Type I “action” as that term is defined in 6 N.Y.C.R.R. Section 617.4 (b)(6); and

b.     The Board desires to conduct a coordinated review and serve as lead agency for the purposes of SEQR; and

c.      The Town is hereby directed to deliver the Proposed Environmental Assessment Form and notify the involved agencies identified in EAF that a lead agency must be agreed upon pursuant to 6 N.Y.C.R.R. Section 617.6 (b)(3) within 30 days of transmittal of the EAF.

Section 2. This Resolution shall take effect immediately.

NEW BUSINESS:

Town Fee Schedule was discussed and no questions were asked and a Motion was made by Supervisor Davis and seconded by Councilman Smith to schedule a Public Hearing on November 6 at 7:05 Pm for Local Law No. 1 of 2024 Fee Schedule.

Town Emergency Preparedness Plan of 2008: Councilman Spellicy said FEMA reached out to the Codes Office to set a time frame and included me in the email. He also reminded everyone about the devastation in North Carolina and FEMA is very busy at this time. We will have to hold off on this for a while.

 

Civil Service Acknowledgements: Supervisor Davis acknowledged to the Board that the following are still on the books at Civil Service and need to be removed because their last pay dates are as follows and the did not leave a resignation letter and they have not returned to work.

PUBLIC COMMENTS/CONCERNS:

 

Mr. Mansfield asked how much revenue would we need to create a Patrol Department in Vienna.

 

Supervisor Davis explained that there would have to be Public Hearings in 2025 to see if residents would be interested in having patrols. There are no numbers to report at this time, but it would be very costly. Even buying Radar Signs and Speed bumps are not cost effective.

 

Mr. Shaughnessy Sr. explained how very expensive the process is, which is in the 100 of thousands of dollars.

 

Supervisor Davis contacted Engineers to do an inspection on the Post Office.

 

Mr. Piper asked who designed the Generator Systems, what fuel do they use, where is the Generator mounted at the Highway Garage and how much noise do they make?

Answer was 911 Generators, Propane fuel and will be mounted at the rear of Garage and would not be very loud.

 

Mr. Shaughnessy Jr stated that North Bay Fire Department has a Generac Generator and is very quiet. And, they are a Red Cross Certified Building.

 

Supervisor Davis stated that once we get the Generators, the Town Hall or Garage could be used in an emergency for example a warming station. The Highway Garage will be able to run everything with the Generator.

 

Mr. Piper wanted it to be on record that the Highway Department is allowed to help him work on the property with the water leak.

 

Mr. Shaughnessy Jr presented an award to the Board for donating money to the Old Homes Day Fireworks. Also, asked if we were still doing the Tree Lighting Ceremony set for December 7th. Answer was yes.

 

 

EXECUTIVE SESSION: Was not entered.

 

ADJOURNMENT:

Councilman Spellicy made a motion to end the Board Meeting at 8:10 pm, seconded by Councilman Lamb. All were in favor.
