TOWN BOARD MEETING 7:00PM WEDNESDAY, November 1, 2023

CALL TO ORDER:

Supervisor Davis called the meeting to order at 7:00pm, followed by the Pledge of Allegiance.

NOCCOG – Lisa Bellinger

Provided an overview of upcoming presentations that will be held during the months of November and December 2023. Refer to the website www.noccog.org for dates and times. She reported that the DEC has announced the Availably of Volunteer Fire Assistance Grant Funding Program. Visit the DEC webpage regarding the grant or call DEC @ 518-402-8839 for more information.

  • The Supervisors Report for the month of October 2023 is complete and is on file in the clerk’s office.
  • Town Clerk Patricia Cook read the Town Clerk’s Report for the month of October 2023.

HIGHWAY:

Clayton Conover Jr. reported the highway garage is currently picking up leaves, the Fire Alarm System is up and running, all the Sand has been delivered and all speed bumps have been picked up for the winter.

COUNCIL REPORTS:

Councilman Spellicy stated that he has been working on the revision of two local laws. The first is to rescind Local law #1 of 2008 and establish dedicated hours of operations for the Office of the Town Clerk. The new Local Law will set the Town Clerks Office Hours as follows: Mondays – Wednesday 8:30am – 4:00pm Thursdays – 10:30an – 6:00pm Friday’s – Closed Second is to revise Local Law #2 of 2018, Ethics Law Revised Local Law #5 2016 with two minor verbiage changes under the Conflict of Interest per advisement of legal counsel. Refer to the website to view both changes. Councilman Smith stated that he had attended the Planning Board Meeting of 10/19/2023. There will be two Public Hearing coming up on November 16, 2023, at 7:00pm regarding residential solar and a vegetable stand and ice cream shop. Councilman Smith noted that he is the Laison to the Planning Board but noted that it would be nice if other Council members attend these meeting. Councilman Smith was asked by a resident if the Board would be interest in a Tree Lighting Ceremony in early December. Board members thought it was a good idea. Supervisor Davis will bring it up at the November 8, 2023, Special Budget Meeting for creating an announcement, posting it in the paper for the date and time of this event. He also said there was a Public Hearing on the North Shore Ambulance Contract at 7:05pm. Supervisor Davis gave an update on the Website and that the technical person has been working with the needs of various departments. Once it is up and running a dedicated person will be responsible for uploading data to the standards set. On November 10, 2023, he would be meeting with an IT representative recommended by Russ Johnson. They will be looking into hardware updates and new telephone systems for the Town Hall. Supervisor Davis received a request from Bookkeeper Ben Gassner to get approval for various budget adjustments for the rest of the year. A motion was made by Councilman Jordan and seconded by Councilman Lamb to approve the Budget adjustments requested by the bookkeeper. Motion carried.

A motion was made by Councilman Spellicy and seconded by Councilman Lamb to approve a $2,500 check to Gates Cole to settle a lawsuit. Motion carried.

OLD BUSINESS:

Bid Opening

Supervisor Davis was handed one bid to open. Maple Flats Construction provided two estimates, one for $36,000 for the roof replacement and $15,000 for the Shed. The Board stated that ARPA money will be used for the cost of these projects. A motion was made by Councilman Smith and seconded by Councilman Lamb to approve the Maple Flats Construction quote to replace Town Hall roofing and the building of the exterior Shed at a combined cost of $51,000. Motioned Carried.

A motion was made by Councilman Jordan and seconded by Councilman Lamb to have Bell Atlantic Mobile System/DBA Verizon Wireless have access to cell tower property.

Hoping to get this wrapped up by year end.

NEW BUSINESS:

Appointment of Jack Cook to the Bar – Jack offered to stay on until the Board could find someone else to replace him. A motion was made by Supervisor Davis and seconded by Councilman Lamb to appoint, Jack Cook to the Board of Assessment Review. Motion Carried:

Requested that a Local Law #5 ;2009 be repealed with section 27 of the Municipal Home Rule Law and replaced to opt in to the 466- exemption consistent with Oneida County Board of Legislators. A motion was made by Councilman Lamb and seconded by Councilman Spellicy to the set the following Public Hearings to be held on December 6, 2023. At 7:05pm Public Hearing 1 – Repeal Local Laws 2003-1, 2006-1, and 2021-2. At 7:10pm Public Hearing 2 – Repeal Local Law 2008-12. At 7:15pm Public Hearing 3 – Amend Local laws 2008-3, 2010-1 and 2011-2. At 7:20pm Public Hearing 4 – Amend Local Law 2012-1.At 7:25pm Public Hearing 5 – Amend Local Law 2009-5. At 7:30pm Public Hearing 6 – Amend Local Law #3 of 2023.At 7:35pm Public Hearing 7 – Revisions to Local Law #2 of 2018 Motion Carried:

Contract for Broad Band:

Supervisor Davis received a commitment from the County for contracting Broad Band signed by Adirondack Tech. He met with the representative to see if they would pick up the hi-lighted areas of Yager Rd, California Rd, all of Elpis Rd to California Rd. to pick up those additional houses in that area. After showing him the areas in question, he agreed to do it for $125,000. They did put it into writing and has been reviewed by our Attorney. This also is ARPA money utilization. A motion was made by Councilman Smith and seconded by Councilman Jordan to execute this contract with Adirondack Tech for $125,000. Motion Carried.

A motion was made by Supervisor Davis and seconded by Councilman Lamb to exit into Executive Session to discuss contract issues and personnel wage issues.
