TOV Zoning Board of Appeals (ZBA) Special Meeting

September 26, 2022

Call to order: 2022 Chairman John Pavelock called the meeting to order at 7:00 pm and led The Pledge of Allegiance to the Flag.

Attendance:

ZBA Members: John Pavelock, Amanda Hewitt, and Joshua O’Kay.

Randy Chandler was unable to attend. There is one vacancy on the board.

Others: Secretary Kathy Pavelock, QCN Reporter Sue Halbritter, and Applicant Gary Natali with his engineer Joe Mastroianni. Zoning/Codes Officer Reay Walker and Liaison Gail Whitham were unable to attend.

Minutes Approval:

Amanda Hewitt made a motion to approve the ZBA January 12, 2022 Organizational Meeting minutes. Seconded by Josh O’Kay. Poll Vote: Amanda Hewitt – Aye, John Pavelock – Aye, Randy Chandler – Absent, Josh O’Kay – Aye, Vacancy – n/a. Motion Carried.

Correspondence:

Secretary Pavelock summarized the correspondence since the last ZBA meeting in January including coordination for this meeting, updating of the ZBA contact list, preparation of ZBA notebooks for each member, and updating the 2022 ZBA Training status.

VAR2022-1 Natali, Gary requesting a variance for Zoning Law Section 1130 A. The Planning Board rejected a Special Use Permit Application based on the applicant’s plan to have only one access road during the early phases of his plan to expand the existing North Shore Estates mobile home park. Location: 234 Beach Rd; Tax Map # 214.000-1-59; Zone: RR-2. The ZBA was provided hardcopies of the variance application, excerpts from the September 15, 2022 Planning Board Meeting, site plans, and a copy of the Special Use Permit application.

Mr. Natali and Mr. Mastroianni provided an overview of the plans to expand the existing North Shore Estates mobile home park. They are planning a three phased project o expand the existing 30 sites by 40 sites. As a first step, Mr. Natali would like to add a model trailer to test the feasibility of carrying through the full expansion. The existing mobile home park is grandfathered as a 30-site mobile home park with only one access road. Mr. Natali is requesting temporary relief from Zoning Law section 1130 A while testing the feasibility of future expansion.

ZBA members asked about using existing sites for the model trailer. Mr. Natali explained that all sites were currently in use (leased). The ZBA also asked about the width of the current access road. Mr. Natali believed that it was wider than the required 20’.

ZBA members also suggested a temporary road similar to what the planning board suggested only shorter. ZBA members also discussed the fact that the model trailer would not be hooked up to sewer or water and therefore not livable and technically not an additional site.

The applicant will consider the suggestions made by the ZBA. The ZBA will continue to research regulations and drive by the location. The ZBA requested that that applicant measure the current access road.


Amanda Hewitt made a motion to schedule a public hearing for VAR2022-1 on October 12, 2022 at 7:10. Seconded by Josh O’Kay. Poll Vote:
