TOWN MEETING MINUTES
October 5, 2022

PRESENT: Supervisor Michael M. Davis Sr., Councilman Jason Spellicy, Councilwoman Gail Whitham, Councilwoman Wendy Herbst

 Absent: Councilman Jason Lamb

CALL TO ORDER:

Supervisor Davis called the meeting to order at 5:30PM.  Pledge of Allegiance.

 

Budget Meeting:

The Deputy Town Clerk made the official statement on behalf of the Town Clerk, “I, Beth Bunce, Deputy Town Clerk for the Town of Vienna have on this 5th day of October given the Town Board the 2023 Tentative Budget”. The Budget Officer, Ben Gasser, stated that due to time we were going to try to get through the salary portion. In regards to the special districts, the Fire Districts (SF4-6) and the Ambulance District’s numbers are accurate as of October 5, 2022. We are looking to get the budgets for Sf1-3, they should be coming shortly. The lighting district budgets should work and they are complete. We ae still waiting for the Sewer Budget from Sylvan Beach, it never goes down so the budget officer budgeted for it to go up slightly in both districts as well as in North Bay Sewer District (SS2). The water districts (SW1-2) had a joint loan that both districts have been paying off for about 30-40 years, that will be paid off in October or November. The other water districts are pretty steady with only about 500-1000 up or down difference depending on maintenance costs. Supervisor Davis stated he believed there should be a cost of living raise each year. This year he believes it should be either a 4% or 5% raise and that the raise amount will change each year. Councilman Spellicy also believes that 4% is a good number and that the Town Board salaries are going to stay the same. The judges get a 4% raise and that was all they asked for. The Town Board will come back to the Court Clerk request. Supervisor Davis will be getting a 3.78% raise. The Bookkeeper will get a 4% raise. Deputy Supervisor will stick with 1,000 dollars but a resolution will need to be made to increase the hourly. The auditor increases by a couple hundred. Budget Officer will b getting a 4% raise. The Assessor rate will be higher because there is an acting Accessor who is training a new Assessor and the acting Assessor Clerk will be training a new Assessor Clerk so their will be four people. The amount increased to 85,160 dollars. The Town Clerk will get a 4% raise. The Deputy Town Clerk will be revisited. Law will stay the same for now. The Cleaner will be raised by 4%. The Animal Control Officer will get a 4% raise. The Registrar of Vital Statistics will get a 4% raise. Highway Superintendent and Highway Clerk will get a 4% raise. Clerk’s and Cleaner are going to be $17.68 an hour. The Zoning Officer and Zoning Clerk will get a 4% raise. The Planning Board Secretary, ZBA Secretary, and ZBA Board will get a 4% raise. The Planning Board Chairman will not get any raise. The Town Board contractual, the Judges Contractual, and the Supervisor’s Equipment will stay the same. The Supervisor’s Contractual and Payroll Service’s will stay the same. The Auditor will increase by 400 dollars. The Board of Assessment Review will stay the same. Assessor Equipment and Contractual will stay the same. Town Clerk Equipment and Contractual will stay the same. The Record Management Contractual will stay the same. The Town Hall Contractual will stay the same. Oneida Lake Petroleum, National Grid, Time Warner, and Grahams Refuse will all stay the same. Office Supplies, Postage, and Copier/Fax will stay the same. Insurance will go up by 2000 dollars. Association Dues, Contingent Account, and Rental Property Maintenance will stay the same. When the Town starts using the AARPA funding we will need a budget adjustment to move money from the Contingent Account to the AARPA funding line. Traffic Control Contractual will stay the same. The Animal Control Contractual and the Registrar of Vital Statistics Contractual will stay the same. The Highway Clerk Contractual and the Highway Garage Contractual will stay the same. The Oneida Lake Petroleum will increase to 25,000 dollars. The Highway Garage National Grid, Propane, Time Warner, and Grahams Refuse will all stay the same. The sidewalks contractual as well as the Publicity will be kept the same. The Programs for the Aging will increase to 7,000 dollars. The Historian will get a 4% raise. The Historian Contractual, celebration contractual, and tree maintenance will all stay the same. The State Retirement will increase to 21,000 dollars. Social Security will increase to 25,000 dollars. Workers Compensation will increase to 11,603 dollars. NYS Unemployment Insurance and Disability Insurance will stay the same. Hospital and Medical Insurance will increase to 30,000 dollars. Resident Refunds, Transfers/ Other Funds and Budgetary Provisions for other users will stay the same. Real Property Taxes and other payments in lieu of taxes will stay the same.

 

NOCCOG: Lisa Bellinger

The NOCCOG 38th Annual Dinner Meeting is the 27th at Delta Lake Inn. The New York State Tughill Commission Annual Dinner is the 20th at Zero Doc Street in Carthage. On December 12, 2022 the remote meetings due to covid has expired. Municipal Infrastructure Webinar is on October 26th, 2022. Tughill is offering a webinar on the 18th, describing how the first amendment and regulations affect signs.

 

County Legislature: Norm Leach

This is the tenth year there has been no tax increase. The dam getting fixed is in motion. A brief report is being prepared and sent to the people necessary to get a course of action planned.

AUDITED VOUCHERS:

A motion was entertained by Councilman Spellicy and seconded by Councilwoman Whitham to approve the audited vouchers beginning with voucher #366 thru voucher #401 in the amount of $166,598.26.  Motion carried.

SUPERVISOR’S REPORT:

The supervisors report for the month of September is done and in the clerk’s office.

All other office reports are in the Town Clerk’s office and will be on line.

 

HIGHWAY:

The sand delivery has started and is going well. Pavement was postponed from last week to this week. The highway department has been out with the gradall doing some brushing. Sold some culvert pipes and received the speed limit signs for Lake Shore Drive.

 

Council Reports:

Councilwoman Whitham- Nothing

 

Councilman Spellicy- One quote for a ventilation system has been received.

 

Councilwoman Herbst- Reconciliation for August has been completed.

 

Supervisor Davis- Nothing

 

Old Business:

Water Study- They are working on getting demographic information that is necessary to put together for potential grants. They are approximately 60% of the way through the study.

 

Town Hall Roof- Started to solicit technical information such as metal roofing.

 

Zoning Law- We have the fifth edition of the draft. This will be placed on the website. The three changes to wording have been added. You can see the differences and they are listed in the commentary.

 

New Business:

Drive 7 Drainage Issues- It needs a ditch but it is not known how to add and maintain a ditch on private property. The Highway Superintendent and the Supervisor will have a meeting with the group of people that are having drainage issues.

 

Public Comments:

Mabel- Wanted to know if there are any rules and regulations on how many people can live in a house/ trailer based off of number of rooms. Supervisor Davis explained that the question will be referred to Reay Walker so that the answer is correct.

 

EXECUTIVE SESSION: 7:34PM Possible Litigation

A motion was entertained by Supervisor Davis and seconded by Councilman Spellicy to enter into executive session for contract review and possible litigation at 7:34pm.  Motion carried.
