TOWN MEETING MINUTES
November 2, 2022

 PRESENT:  Supervisor Michael M. Davis Sr., Councilman Jason Spellicy, Councilwoman Gail Whitham, Councilwoman Wendy Herbst, Councilman Jason Lamb

CALL TO ORDER:  Supervisor Davis called the meeting to order at 7:04PM.  Pledge of Allegiance.

NOCCOG: Joe Rowlands

Last Thursday NOCCOG’S banquet was held and the food was good and the evening was enjoyable. Budgeting and accounting training for municipalities will be provided. It is a two-day training on town governments and financial requirements and regulations. That will be on Tuesday November 29th and Wednesday November 30th at 9am – 4pm each day at the Tailwater Lodge in Turin. They have ten rooms available. The cost is $75 a day for a two-day training. Registration is $125 for two days. Both days include a continental breakfast and a lunch buffet. The agenda is available in the announcements. 2021 visitor spending is up 164% on Oneida County. Visitor spending supported 19,939 people employed directly, indirectly, or induced to travel or tourism jobs in Oneida County. This generated 1.2 billion household wages. Oneida County has been awarded a 2.25 million Veteran Suicide Prevention Grant. The funding was issued for three years at $750,000 per year through the US Department for Veteran Affairs. Tughill will be hiring an experienced senior planner or an entry level planner.  

County Legislature: Norm Leach

County Legislature Norm Leach unfortunately, could not make it due to a County Budget Meeting.

AUDITED VOUCHERS:

A motion was entertained by Councilman Lamb and seconded by Councilman Spellicy to approve the audited vouchers beginning with voucher #402 thru voucher #441 in the amount of $162,523.39.  Motion carried.

SUPERVISOR’S REPORT:

The supervisors report for the month of November is done and in the clerk’s office.

All other office reports are in the Town Clerk’s office and will be on line.

TOWN CLERK’S REPORT:

The Clerk read her report for the month of October.

HIGHWAY:

Greg DeRochie was approved at the last meeting to fill the highway position but he chose not to take the job. Clayton believes that Mike Lust should replace Greg to fill this position. Mike has all of the qualifications needed.

 

A motion was entertained by Supervisor Davis and seconded by Councilman Spellicy to hire Mike Lust for this position based off of Highway Superintendent Clayton’s recommendation.

The highway garage has been busy picking up leaves and installing culverts. There are still some culverts to install. All sand has been delivered. Latitisa has programmed the speed limit signs and they were installed on Lake Shore Drive.

 

Council Reports:

 

Councilwoman Whitham- There are two new pavers that will be put in to the Veteran Memorial as the last details added this winter. Will be putting an ad in the paper thanking all veterans and their families. There was a gazebo that looked to be of appropriate size and in good condition that Councilwoman Whitham wants. Approaching the idea of adding solar lights to the pond. This is inexpensive way to light up the area.

 

Councilman Spellicy- Received a quote on air and heating units for the meeting room. Looking into split unit heat pumps to help offset the cost of heating oil. The quote is from Breath Easy in Cleveland, NY. It is for 32,000 btu at 5-degree temperature put out. The boiler will still be needed because of how the offices are separated. The goal is to keep it simple so if an addition to the building is added the units can be moved to heat and condition the new rooms. There is a 11-year parts warranty and 5-year labor warranty offered.

Old Business:

Resolution #27 of 2022; The Town of Vienna Comprehensive Plan-

A motion was entertained by Councilman Spellicy and seconded by Councilwoman Whitham to adopt Resolution #27 of 2022; The Town of Vienna Comprehensive Plan.

Supervisor Davis read off each section of the Negative SEQR form and all of the Council members and Supervisor agreed that they were all a no.

 

Resolution #28 of 2022; Zoning Law Revision 2022 Negative SEQR Declaration-

A motion was entertained by Councilwoman Whitham and seconded by Councilman Spellicy to adopt Resolution #28 of 2022; Zoning Law Revision 2022 Negative SEQR Declaration.

Law #1 of 2022; Changes to the Town of Vienna Zoning Law-

A motion was entertained by Councilwoman Herbst and seconded by Councilwoman Whitham to adopt Local Law #1 of 2022; Changes to the Town of Vienna Zoning Law.

Broad Band-

Supervisor Davis reached out to James Genovese and was told the process is held up with the lawyers. 

 

New Business:

Petitions for speed change on State Route 13 and Lake Shore Drive-

Supervisor Davis did a ride along and received petitions for a speed change for State Route 13 and Lake Shore Drive. These petitions are from residents who live on Lake Shore Drive at that intersection. The residents feel the noise from that rapid increase is imposing on their rights to a quiet neighborhood. These need to be forwarded to the state. An official form has to be filled out and will be forwarded to the state. This takes approximately 2 years.

 

Budget Adjustments for October 31, 2022-

A motion was entertained by Councilwoman Whitham and seconded by Councilman Spellicy to approve the budget adjustments up to October 31st of 2022.

Public Comments:

Rick Johnson- No other outreach about consolidation talks to him or the Sylvan Beach Fire Department. He has not talked to anyone about consolidation and wanted to make that known. The Sylvan Beach Fire Department is not against it. Wants a committee formed to sit down and talked about it. Heard about the complaint of the Sylvan Beach Fire Department purchase of a new apparatus. He is willing to answer any questions regarding that purchase. Seventy Feet is on the lower side for range because you may have to park far away. In a two-story building seventy feet can still barely reach it. Asked amount from grant was a lot less then what was needed. They did not settle for this truck they researched it and it was in the budget. Replaced a latter truck and an engine truck with this truck. There is training for the volunteer firefighters to use the new truck. The building they rent will fit the truck. There are renovations to the main fire house as well, being they have no room. The Oneida Indian Nation has not put money into anything to help out.

 

Dean Maracchion- At the April Meeting Councilman Spellicy, Councilman Lamb, and Supervisor Davis agreed to remove the negative statements on the Comprehensive Plan, this is still included on the comprehensive plan. Why? Councilman Lamb stated they entertained the idea but they did not agree to it or make the changes.

 

EXECUTIVE SESSION: 8:25PM Employee Pay Issues and Possible Litigation

A motion was entertained by Supervisor Davis and seconded by Councilman Spellicy to enter into executive session for employee pay issues and possible litigation at 8:25pm.  Motion carried.
