TOWN MEETING MINUTES
December 1, 2021

PRESENT: Supervisor William A. Graham
Councilman Michael M. Davis Sr.

CALL TO ORDER:
Supervisor Graham called the meeting to order at 6:00PM.  Pledge of Allegiance.

There was a meeting between the Town Board and the Planning Board with discussion of everything they had discussed during their previous meeting.  The board was happy with all of the changes and asked the planning board to get the final draft written up.

COUNTY LEGISLATOR: NORM LEACH
Norm said that they passed the County Budget with no tax hike.  They increased the budget for the county roads.    

GATES AND COLE: Leslie Grogan
Leslie was here and went over the Towns insurance policy making sure everything was to the boards liking.  Making sure all equipment and structures were insured.  She let the town know there was a 3.4% increase in the standard rate or we could change the deductible.  The board did not want to change the deductible. 

OPEN COUNCIL SEAT:
A motion was entertained by Councilman Davis and seconded by Councilwoman Whitham to appoint Ron Cole to the open council seat that was vacated by Lorraine Padavan back in June.  Motion does not carry.

PUBLIC HEARING: LOCAL LAW #3 OF 2021 CANNABIS OPT OUT

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Vienna will be holding a Public Hearing Wednesday December 1, 2021 at 7:05 PM at 2083 NYS Route 49, North Bay, NY 13123 regarding Local Law #3 of 2021 A Local Law to Opt Out of the retail Cannabis Dispensaries and/or on site Cannabis consumption establishments within the Town of Vienna

A copy of the Local Law is available for public inspection on line at tovlookup.org or via email by request from the Town Clerk at townclerk@tovlookup.org 

At such public hearing, all persons will be given an opportunity to be heard. 

A motion was entertained by Supervisor Graham and seconded by Councilman Davis to open the public hearing at 7:27pm.  Motion carried.

A motion was entertained by Supervisor Graham and seconded by Councilman Lamb to adopt Local Law #3 of 2021 Opt Out of the Retail Cannabis Dispensaries and/or on site consumption establishments within the Town of Vienna.  Motion does not carry.

A motion was entertained by Supervisor Graham and seconded by Councilman Lamb to approve the minutes of the November 3^rd meeting.  Motion carried.

AUDITED VOUCHERS:
A motion was entertained by Councilman Lamb and seconded by Councilwoman Whitham to approve the audited vouchers beginning with voucher #438 thru voucher #478 in the amount of $139,525.12.  Motion carried.

SUPERVISOR’S REPORT:
The supervisors report for the month of October is done and in the clerk’s office.

All OTHER OFFICES MONTHLY REPORT:
All other office reports are in the Town Clerk’s office and will be on line.

TOWN CLERK’S REPORT:
The Clerk read her report for the month of November.

A motion was entertained by Supervisor Graham and seconded by Councilwoman Whitham to accept the clerks report.  Motion carried

HIGHWAY:
The Superintendent announced that Old Route 49 is completed and now open.  The VVS School donated the Willow Trees for the project.  The truck that needed repair work is still at Tracey’s.

SYLVAN BEACH:
The trustee (Mark Daley) was present to answer any questions about the Villages request for funds to help with the park fund.

A motion was entertained by Councilman Davis and seconded by Councilwoman Whitham to donate twelve thousand five hundred ($12,500.00) dollars to Sylvan Beach for the Park fund.  Motion carried.

HUMANE SOCIETY:
A motion was entertained by Supervisor Graham and seconded by Councilman Davis to sign the contract with the humane society of Rome with a two hundred ($200.00) dollar consideration per dog sent to them.  Motion carried.

HIGHWAY EXPENDITURES:

A motion was entertained by Supervisor Graham and seconded by Councilwoman Whitham to sign the highway expenditures for the 2022 year.  Motion carried.

A motion was entertained by Supervisor Graham and seconded by Councilman Lamb to re-appoint Ava DelPozzo-Guyer to the BAR.  Motion carried.

BUDGET ADJUSTMENTS:

A motion was entertained by Supervisor Graham and seconded by Councilman Lamb to authorize the budget adjustments as requested by the bookkeeper and attached.  Motion carried.

The end of the year meeting will be Tuesday December 28^th at 11:00AM.

A motion was entertained by Supervisor Graham and seconded by Councilman Lamb to enter into executive session for personnel issues at 8:37pm.  Motion carried.
