Town of Vienna Planning Board - Regular Meeting

March 17, 2022

Call to order: Chairman Calvin Collins called the meeting to order at 7:02 pm with a quorum present.

Attendance:

Board Members: Bill Shaughnessy, Calvin Collins, Orrin MacMurray, and Martha Link.

David Gigon was unable to attend. There are two vacancies on the board.

Others: Secretary Kathy Pavelock, Liaison Gail Whitham and several residents. Zoning Officer Reay Walker was unable to attend. Supervisor Davis attended to start up the Zoom teleconference for several residents requesting to attend by Zoom.

Correspondence:

  • Received written resignation from Mike Piper and informed Chairman Collins.

  • Coordinated Public Information Meeting on the Zoning Law updates for March 9, 2022.

  • Received review results from Oneida County Planning related to SUB2022-01.

  • Coordinated signing of plats for SUB2022-01 and Relot2022-01.

  • Filed plats for SUB2022-01 and Relot2022-01.

    Residents asked about the agenda not being on the website. Secretary Pavelock sent it to the Town Clerk to post on the website. Secretary Pavelock will ask the Town Clerk to place agendas on the home page.

    Public Hearings: None Unfinished Business:

    Angelwood Estates, LLC, SUB2020-02; Myers & Associates; Major subdivision on Route 49 near Drive 6; Tax Map# 214.000-1-34. Myers was not in attendance. The board commented that Myers will inform us when they are ready to discuss the next steps. Tabled to next meeting.

    Local Gas, LLC (Tom Kilts), SUP2021-07 – Special Use Permit at 2020 NYS Rte. 49; 217.017-1-57. Addition of a lean-to on the side of existing pole barn. Tom Kilts was not in attendance. This was tabled until withdrawal letter or other action by the board. The board advised the secretary that there is no need to keep this on the agenda.

    New Business: None

    Sketch Plan Reviews:

    Jeff Moore asked to discuss a possible Subdivision/Re-allotment for Beers and Wilson property on McConnellsville Road. These are current non-conforming properties that do not meet the 200’ road frontage requirement. Mr. Moore was wondering if this would be a subdivision or a boundary line adjustment. Also was wondering if the Zoning Board of Appeals needs to review. Mr. Moore explained that there are 2 lots now and after the adjustments there will still be 2 lots. After discussing and referring to the Subdivision Law, the Planning Board agreed that this would be a re-allotment since there are 2 lots to start with and will end up with 2 lots in the end. Mr. Moore was reminded that paid applications need to be received by April 14, 2022 to be placed on the agenda for April 21, 2022.

    Other:

  • Zoning Law Updates –

    Orrin MacMurray provided a summary of the status of the proposed Zoning Law updates. The goal tonight is to pass a resolution to recommend the Zoning Law updates to the Town Council. A summary of the main comments received from the public were reviewed including:

    • Airstrips definitions – update with changes suggested by Rick Mansfield

    • Clear Zone definition – the board felt that the changes suggested by Rick Mansfield are not necessary, however, “to enhance safety” will be added to the definition.

    • Manufacturing – As suggested by George Bittner, the maximum size for Small Manufacturing will be increased to 4,000 sq. ft., The minimum for Large Manufacturing will be increased to 4,000 sq. ft.

    • Many residents expressed their opinion that the statement, “Uses not specifically …” should be removed. The board agrees with removing this statement.

    • Zones for Large Manufacturing – George Bittner commented that Large Manufacturing is suitable for RR2 and RR3 in addition to C since RR2 and RR3 are proposed to allow Large Retail Sales and Industrial Zone. The board agreed.

    • Page 24 – Changes suggested by Reay Walker will be incorporated into Section 510 Manufacture Home based on NYS Codes.

    • Page 27 – Insert “or”

    • Page 53 – Add “and not attached to a building or connected to the electric service” for Minor solar Electric Device.

    • Page 60 – Section 1540 paragraph 5. Remove “all” as suggested by George Bittner.

    • Page 71 – Section 2015. Adjust wording for “Registered Architect or Licensed Engineer.”

    • Pages 54-55 – Tier II Solar Electric. The board discussed the pros and cons of requiring a Special Use Permit for Tier II Solar Electric. The board thought it would be appropriate to require a Special Use Permit to that input could be obtained from the public and to require screening as needed. The requirement for a Special Use Permit will also be added for Solar Thermal (Small Scale).

    • Mac also explained some of the other comments from the Public Information Meeting including: Defining Abandoned (no good definition), Adding Airstrip Personal Use (already addressed and covered), Political Signs (addressed at March 9 meeting), Suggestion for fines (set by state law), suggestion for signs (no issues with current law), Require liability insurance for airstrips (not feasible or reasonable).

      A motion was made by Orrin MacMurray, seconded by Bill Shaughnessy, to make the changes to the proposed Zoning Laws as discussed this evening and forward the proposed Zoning Law updates to the Town Council. Poll Vote:

  • Cannabis Dispensaries.

Bill Shaughnessy reported that this is being actively worked on by the Village of Sylvan Beach. As soon as he has some information, he will share it with the town.

Public Comments:

Tom Moore – Arrived in person when the Zoom connection dropped during discussion of the proposed Zoning Law. He said he could not find a copy of the proposed Zoning Law changes on the website.

Secretary Pavelock provided a copy to Mr. Moore.

Dean Marachion – Reported that the copy on the website was not copied correctly (missing every other page).

Tom Moore – Question on Micro Solar and why the zoning law was not based on area rather than wattage or connection to electric service.

Next Meeting: March 17, 2022. Agenda items are due to the secretary by March 10, 2022.

Orrin MacMurray made a motion to adjourn. Seconded by Bill Shaughnessy. All in favor. Motion carried at 9:11 PM.
