Town of Vienna Planning Board - Regular Meeting

June 16, 2022

Call to order: Chairman Calvin Collins called the meeting to order at 7:03 pm with a quorum present.

Attendance:

Board Members: Calvin Collins, Orrin MacMurray, Martha Link and Bill Shaughnessy.

David Gigon was unable to attend. There are two vacancies on the board.

Others: Secretary Kathy Pavelock, Liaison Gail Whitham, QCN Reporter Susan Halbritter, several residents/applicants, and Supervisor Davis. Codes/Zoning Officer Reay Walker was unable to attend.

Minutes Approval:

A motion was made by Bill Shaughnessy, seconded by Orrin MacMurray, to approve the May 19, 2022, regular meeting minutes. Poll Vote:

    While waiting for the appointed time for the public hearing, the board discussed the following:

    • Zoning Law updates – Orrin MacMurray explained that there are no new updates to the proposed Zoning Law updates. Orrin will be providing a summary of the proposed changes at the public hearing scheduled for June 21 7 PM at the Highway Garage.

    • Other Zoning Law topics – the board briefly discussed the status of the cannabis dispensaries. The state has not distributed the draft rules/requirements yet. Most likely they will be distributed later this year.

      There were no comments from the public. There was one question from the board asking about the location of the property.

      Unfinished Business:

      Oceanfront Properties NY LLC, SUB2022-02; Moore Land Surveying; 2-lot Subdivision;

      9647 Elpis Rd; Tax Map# 182.000-1-6; RR3, 14 Acres. This subdivision did not require a 230m review (Not within 500 ft of: State/County Road, Municipal Boundary, State Land, Ag. District). Orrin MacMurray made a motion, seconded by Bill Shaughnessy to approve the Angelwood Estates, LLC subdivision SUB2020-02. Poll Vote:

      Orrin MacMurray – Aye Bill Shaughnessy – Aye Calvin Collins – Aye Martha Link – Aye Dave Gigon – Absent Vacancy 1 – n/a Vacancy 2 – n/a Motion Carried.

      The applicant will file the plats with Oneida County.

      New Business:

      Scott Zahas, SUB2022-03; 4-lot Subdivision; Yager Rd & NYS Rte 13; 19 Acres.

      Tax Map# 200.000-1-83.12; Zones RR1 & RR2. The board reviewed the preliminary plat. Mr. Zahas explained that he would like to request a change to the plat, increasing the road frontage for the lower lot 3, taking some land from the upper Lot 3. The plat will be corrected to list the lower Lot 3 as Lot 4. The board reviewed the Short Environmental Assessment Form part 1 and completed parts 2 and 3. Orrin MacMurray made a motion, seconded by Bill Shaughnessy to declare a negative environmental impact for SUB2022-03 and to schedule a public hearing for July 21, 2022 at 7:10 PM. Poll Vote:

      Sketch Plan Reviews: None

      Other:

      Chairman Collins asked Liaison Whitham if she had any comments. She had nothing new to report. The board asked if there were any applications for the two Planning Board vacancies. She stated there are none yet.

      Public Comments:

      Supervisor Davis

    • Supervisor Davis stated that there have been several ads placed about the vacancies, but there have been no responses. He has been talking with some residents who would be willing to fill-in temporarily. However, this will require a change to the Law. He will continue to work on this situation with the Town Council.

    • The Comprehensive Plan will not be completed before the approval of the updated Zoning Laws. A SEQR needs to be completed. He stated that there is no clock on approving the plan since it is not law. He has confirmed this with Assoc. of Towns, Oneida County, and the Tug Hill Commission.

    • Supervisor Davis requested that all Planning Board Members try to attend the June 21 Public Hearing. Orrin MacMurray will provide a chronology and summary of changes prior to opening the floor for public comment.

Next Meeting: July 21, 2022. Agenda items are due to the secretary by July 14, 2022.

Orrin MacMurray made a motion seconded by Bill Shaughnessy to adjourn. All in favor. Motion carried at 7:48 PM.
