Town of Vienna Planning Board - Regular Meeting

July 21, 2022

Call to order: Chairman Calvin Collins called the meeting to order at 7:07 pm with a quorum present.

Attendance:

Board Members: Calvin Collins, Dave Gigon, Martha Link and Bill Shaughnessy. Orrin MacMurray was unable to attend. There are two vacancies on the board.

Others: Codes/Zoning Officer Reay Walker, QCN Reporter Susan Halbritter, and residents/applicants.

Secretary Kathy Pavelock was unable to attend. Dave Gigon took notes for the minutes Liaison Gail Whitham was also unable to attend.

Minutes Approval:

A motion was made by Bill Shaughnessy, seconded by Martha Link, to approve the June 16, 2022, regular meeting minutes. Poll Vote:

Correspondence:

Chairman Collins explained that correspondence since the last meeting is listed on the agenda and as follows:

  • Legal Notice for the Public Hearing Zahas Subdivision SUB2022-03.

  • Submitted 239m referrals and received all agencies responses for Zahas Subdivision SUB2022-03

  • Distributed memo from Orrin MacMurray to board regarding observations following the proposed Zoning Law updates Public Hearing held on June 21.

  • Assisted residents with applications.

Unfinished Business:

The board had a brief discussion regarding buildable lots, driveway permits, and driveway locations. Chairman Collins provided some history of the area and property. David Gigon stated that all agencies responded to the 239m referral and none of the agencies had comments.

Sketch Plan Reviews:

Special Use Permit: North Shore Mobile Estates – The applicant, Gary Natali submitted his application for a Special Use Permit (SUP2022-01) to expand the existing Mobile Home Park at 234 Beach Road, Tax Map # 214.000-1-59.

The Planning Board reviewed the preliminary plans. Codes/Zoning Officer Reay Walker stated that at this initial phase, the plan looks good as the property has sewer and water. Mr. Natali provided some history of his prior approval from 2003. He would now like to add 40 sites to the park. The board held a brief discussion with Codes Officer Walker about regulations for manufactured homes, tiny homes, mini homes, and park models. Mr. Natali also informed the board that he has been in contact with the Village of Cleveland administration since the property is adjacent to the village. The board explained the SEQR will require additional information and that this board cannot grant “conditional approvals.” Mr. Natali will come to the next meeting.

Other:

Zoning Law Updates - Chairman Collins explained that the Town Council will reopen the Public Hearing in August on the proposed updates to the Zoning Law.

Cannabis – Codes/Zoning Officer Walker and Bill Shaughnessy expressed their agreement that at this point in time the only action the town can take is to decide which zones that this use will be allowed in.

Next Meeting: August 18, 2022. Agenda items are due to the secretary by August 11, 2022.
