TOWN MEETING MINUTES
August 3, 2022
PRESENT: Supervisor Michael M. Davis Sr., Councilman Jason Spellicy, Councilwoman Gail Whitham
Absent: Councilwoman Wendy Herbst, Councilman Jason Lamb
There was a meeting at 7:17pm during the Town Board meeting with the Town Board on a public presentation on changes to the zoning law. The meeting concluded at 8:07pm.
CALL TO ORDER:
Supervisor Davis called the meeting to order at 7:01PM. Pledge of Allegiance.
NOCCOG: Lisa Bellinger
Oneida County compiled a dashboard that contains information on electric vehicles. They are tracking how many are registered in the county and the various charging stations available. There is a link on the Oneida County website. Last month’s two webinars on solar energy development were very informative for both private land owners and municipalities. The link is on the NOCCOG announcements. Oneida County is seeking input from residents eighteen years or older on a Community Health Assessment Survey. This can be found on the Oneida County website. A short-term rental issue paper is available through the NOCCOG website. This regulates the rentals that are less than 30 days. Cornell Local Roads Programs have summer webinars through the month of August, yearly. New York State is offering grant opportunities to upgrade downtowns. New York Forward Capacity Building Webinars run August 11th through September 8th, weekly. The webinars are made to help articulate and liven downtowns. The state allocated $100,000,000 to the first round of the New York Forward Program.
County Legislature: Norm Leach
Mcclanathon Ave is not on the county docket to do Mcclanathon Ave this year. Sky Dome is now in operation down at Griffiss. It is a project that isolates drones from interference of radio waves. Approved a contract with the Sherriff’s to purchase new cameras for the Sherriff’s patrolmen. When the Sherriff pulls his gun or taser the camera will automatically turn on.
Supervisor Davis noted that the $30 water bottles were addressed and that a peddler’s permit is needed in order to sell the water. This does not fall into a codes issue. Councilmen Spellicy noted that a person will have to call the Sherriff’s and then they will issue an appearance ticket and they will have to go in front of the Town Justice. The Narcotics Division is looking into the water bottle for substance issue.

A motion was entertained by Councilman Spellicy and seconded by Councilwoman Whitham to approve the audited vouchers beginning with voucher #284 thru voucher #323 in the amount of $131,118.75. Motion carried.

SUPERVISOR’S REPORT:
The supervisors report for the month of July is done and in the clerk’s office.

TOWN CLERK’S REPORT:
The Clerk read her report for the month of July.
HIGHWAY:
Chris Birch is looking to do a two-year snow plow agreement. He wants to get $400 the first year and $100 the second year. There may be a fuel adjustment.
Supervisor Davis sated we received two tree bids by the deadline. The first one is from Walker Tree Care. They stated to remove four trees and tree trunks must be three feet below. Doesn’t meet the specs being we needed ten feet below and they stated three feet below. The bid was $3,200 and they provided all the proof of insurance. The Town wanted tree trees removed and they stated four trees. The second one is from Rick Turk Tree Service. Tree removal at 7335 Lake Shore Drive will be $2,200. Tree removal at 134 Drive 16 is $1,200. Tree removal at 7449 Lake Street Jewel is $875. The bid was $4,275, they provided all necessary proof of insurance, and met all the specs.
A motion was made by Councilman Spellicy to go with Rick Turk Tree Services’ bid and seconded by Councilwoman Whitham. Motion Carried.

Council Reports:
Councilwoman Whitham– Would like to work on getting the gazebo put up before fall. Does not have the information to get the names of people who want to get their pavers done. Got in touch with someone who said that we can use the old pavers. There is five people who want one.

Old Business:
Water Extension- The project is underway and the first bill was received in the amount of $2,000. It will take time to work on it being the company is doing it in compliance so that we can get grants to help pay the cost. The last petition was included.
Harborview Drive Noise Complaint- Supervisor Davis had a face-to-face meeting with the administrator of sales and Mayor Sullivan of Sylvan Beach. Concerns addressed about proper etiquette being work will start at 7:00am. They agreed they will have a conversation with the company. Feedback, from Village of Sylvan Beach Clerk Wanda, on the instance they started at 6:00am was that it was a rental dozer and the rental company showed up with a low boy to move it. Both the Town of Vienna and the Village of Sylvan Beach have only received one complaint total. They will start an hour later in the morning and end an hour later in the afternoon. There have been no further complaints.
Town Hall- Councilman Spellicy is leading the project. The goal is to get a new roof on the building before winter. This is so we do not have the ice jams and the highway guys do not have to shovel the roof. There is a cap as far as a certain amount of money has to be requested for proposal and the others have to be three bids. The Town is being advised by legal at the moment to determine where that price will be. The Town is still waiting for the numbers for the UV Filtration, part of the judges grant. The idea is when the next sickness happens the air in the building is being filtered. This will provide year-round filtration. Everything is slow moving. Interest in expanding the building is to double the size of the meeting hall as well as other reasons. If the building is expanded the court system is out of compliance with New York State. This includes a separate bathroom for the court, an access so that you do not have to go through the building, a room where they can lock people into during their wait to be heard from the judge, a room for the attorneys and the district attorney, and more provisions about the structure of the judge’s chambers. A report was due to the treasury on April 15th on our intentions for the money and we heard back and our goals are in compliance.
New Business:
Debit Card- Certain things we need to buy you can not take a check for. The debit card would be attached to the General Account. You can set the debit card up to have a limit on the amount you can spend. There would be no interest fees on a debit card. The Town needs to modernize in order to keep up with the times and be able to function. The limit can be adjusted at any time.
A motion was entertained by Supervisor Davis and seconded by Councilwoman Whitham to allow Ben Gasser to set up a debit card and have a $500 limit on said card. Motion carried.

Grinder Pumps- In July the grinder pump above the car wash station the grinder pump failed and they put in an E-1 grinder pump. The Town ordered 4 grinder pumps and already used 2 of them. It takes 1 hour and 15 minutes to completely update to the new E-1 grinder pumps.
A motion was entertained by Supervisor Davis and seconded by Councilman Spellicy to purchase 2 additional E-1 grinder pumps for $3400 each. Motion carried.

Public Comments:
Steven Coccia- Concerned about the speed of cars on Lake Shore Drive. At the beginning of June 2 speed readers were ordered and the Town is still waiting on them. Believes petition was not addressed because it was not to get speed indicators it was to reduce the speed on the road from 30mph to 25mph or 20mph. Currently wants speed bumps on Lake Shore Drive. The speed bumps are readily available. When the signs come in the speed bumps will be put next to them. Bump signs need to be places on both sides to notify the people of the speed bumps. The speed bumps will be removed at the beginning of fall. Clayton, from the highway garage, went through the study and the State told him that the speed limit cannot be lower than 30mph. Wants the curve sign lowered from 30mph. The lowering of the curve sign will be looked into. Requests that State Troopers and Sherriff’s watch the road early in the mornings. Supervisor Davis stated that there has been Sherriff’s’ there on occasion that he knows for a fact. They are short workers and can not stay in one area for long. They go and sit at the road and need to leave to go to calls or they get there later because they have to finish up what the last shift did not do. Actions are being taken but is going slowly.
