A LOCAL LAW TO RESCIND

Local Law No. 6 of 1998

A LOCAL LAW TO REGULATE THE AGE OF MOBILE HOMES SITUATE OR TO BE SITUATED IN THE TOWN OF VIENNA, PROVIDE FOR SKIRTING OF MOBILE HOMES, PROHIBIT MOBILE HOMES IN THE TOWN’S SHORE RESIDENTIAL ZONE, CHANGE THE DEFINITION OF DOUBLE WIDE MOBILE HOME AND PERMITS THEN IN CERTAIN ZONES AND CORRECT AN ERRONEOUS REFERENCE TO A CERTAIN SECTION OF THE ZONING LAW

Be it enacted by the Town Board of the Town of Vienna as follows:

Section I.

Local Law #6 of the year of 1998 regulating the age of a Mobile Home, providing for skirting of mobile homes, prohibiting mobile homes in the town’s shore residential zone, change the definition of double wide mobile home and permits then in certain zones and correct an erroneous reference to a certain section of the zoning law is repealed in its entirety.

Section II.

The local law of 1998 is not enforceable due to the Municipal Regulation of Mobile Housing published on 12/1999 and Reprinted on 1/2008, page 2 paragraph 3.

“Municipalities may not make a distinction based on the age of any homes which have a HUD seal, such as only allowing mobile homes less than five years old to be placed on individual lots”.

The rest of the law is enforced through NYS codes and the Town of Vienna current Zoning Law.

Section III.

This Local Law will take effect immediately upon filing in the Office of the Secretary of State.
