LOCAL LAW NO. 4 OF THE YEAR 1994 – A Law Regarding Snow Removal

WHEREAS, pursuant to the powers granted under §130(4) of Town Law, the Town Board deems it necessary and proper to enact a local law requiring landowners to remove ice and snow from any and all sidewalks abutting and/or traversing their property in the Town of Vienna, to contribute to the public welfare, safety and good order, and to contribute to the safe conveyance of its people over the sidewalks therein.

NOW, THEREFORE, it is hereby enacted as follows:

Section I: It shall be the duty of the owner and/or occupant, of each parcel of real estate abutting a public sidewalk to keep said sidewalk free from snow and ice for the full width and length of such sidewalk.

Section II: Snow and ice shall be removed as soon as practicable, but in any event, within twenty-four (24) hours after the end of a snowfall. At any time when an accumulation of snow and ice shall be frozen so hard that it cannot be removed without damaging the sidewalk, it shall, within the time specified herein, be covered with ashes, sand, salt or other suitable material. As soon as practicable thereafter, the sidewalk shall be completely cleared of snow and ice.

Section III: Whenever an owner or occupant fails to remove the snow and ice from any such abutting sidewalk within the time specified herein, or within twenty-four (24) hours after notice by the Town to remove same, the Town Board shall provide for the removal of said snow and ice from such sidewalk, and shall thereafter notify the Town Clerk of the removal expense incurred for labor and materials.

Section IV: The Town Clerk shall thereafter promptly present a bill for the removal of said snow and ice to the owner and/or occupant of the real estate abutting to such sidewalk. If said bill is not paid within 30 days, the cost thereof shall be assessed against the property and become a lien thereon, collectible in the same manner as delinquent Town taxes.

Section V: No person, firm, corporation or other entity shall deposit, thrown, place, or cause to be deposited, thrown, or placed, any snow or ice on any highway, road, or its respective right-of-way within the Town.
